Federal judge deemed absolute ban unconstitutional.
Although last month’s appeals court ruling initially upheld the total ban, U.S. District Judge Lee Yeakel of Austin, TX submitted a new ruling on Thursday that allowed for clinics to continue to perform abortions in exceptional cases, such as for individuals using medication or for those whose health would suffer with a delay. The total ban would have made all abortions illegal for the duration of the coronavirus, which Yeakel said flew in the face of previous Supreme Court rulings.
This conversation over the essentiality of abortions and abortion clinics during the epidemic is not unique to Texas. Legal skirmishes over the issue are currently being fought in the states of Alabama, Ohio, Oklahoma, and Iowa.
